The pain of waiting for 9-yrs is nothing compared to the wait now (after dates got current)...Refreshing my yahoo mail on iPhone atleast twice per hour, Clicking on Safari where the last visited page is that of case status online (Click the status btn frequently) --- Life is difficult :(

Well if you look at the big picture, assume the data is complete, about 233,000 total pending EB apps. Forget about the country, category, etc. for a minute.
New apps are coming in if PD current in monthly Visa Bulletin. If you get a velocity of these news apps by month/year then this becomes kid level math, given that 140,000 gets approved each year, don't know if that's a fact though.
So are there 100,000 new EB apps a year? or 50,000? Something else? That's Visa Bulletin dependent though.

What they did on Wall Street was short selling of stocks. This is nothing to do with real estate. Short selling of real estate is a way for Lenders to get the marlet value of the property instead of foreclosing it for no value at all. This is something which is approved by the lenders based on the market. Nothing illegal in it.

It was not illegal (since Paulson and Dubya have deregulated the market so much) but it has now led to the biggest economic downturn in decades, has decimated the retirement savings of millions, and led to millions losing their homes and jobs. Nothing illegal, good for the people who made those decisions (millions in bonuses) but absolutely disasterious for society as a whole.

All these other firms which came tincan in hand begging for taxpayer bailouts should all also, by default cancel all salaries and bonuses for the execs. Without legislative or administrative reform, EB3-India would be reduced merely to a mechanism which folks would use to extend their H1Bs indefinitely on the basis of the underlying I-140, or a means to lock a priority date while they plan their strategy for an EB-2 petition for a PD port in the future. As some analysts have predicted, EB3-India wait times might get extended to decades without some sort of reform. Not to make light of the situation, but for an EB3-I applicant with a recent PD, the odds of getting a green card through a US-born child (once they turn 21) could become greater than through their own EB application.

Good suggestion, I didn't ask about EAD, I will check next time. But I guess evantually EAD would be revoked after I485 is denied. I think H1 is a backup plan if MTR denied and till appeal is decided..

Can somebody frame a letter that we can use to report L1 fraud. And, folks its big companies like accenture and hewitt too exploting loopholes in L1. in my current place, most of experienced workers will be replaced by folks on L1. I dont want to come across as negative. My only point is if there are any violations, lets report it and have everybody follow the rules and regulations...

please ignore the dots...the important thing is to make the lawmakers aware of the issue. As mirage mentions we should send a letter to the rep Logfren, (i have mailed the letters), we just want them to be aware that there is an issue, ROWs please send them too, you will also be impacted. Nothing against EB2's or the comments they have passed so far, we dont want to undermine your visas, the idea here is simply to make the lawmakers and DOS/USCIS aware of the problem.
In a way DOS/USCIS have opened a pandoras box because EB3 as a whole will see slower approvals leading to a larger number of countries stuck in the process across a spectrum of countries. earlier it was mainly india, china and mexico. If visa allotment policy holds then you will see more countries getting retrogessed.

The Priority Date refers to the date your Labour Certification Application (LCA) was filed and the I-485 Processing date refers to your Adjustment of Status Application- specifically, it is the filing date of the I-485 application(s) that they are now processing. Translated, that means about nine months to get your Green Card once your PD becomes current. Fortunately, the processing time for an EAD in Nebraska still stands at about 2.5 months.

one update: after a month the consulate asked me for a scaned copy of my I-797 aproval. sent it to them the that very day. called them up two days later to confirm if they recieved it and if the processing was done? the answer was "yes we recieved it" and "sir, it will take time" .. has anyone been requested for a scanned copy of their 797 by Chennai or other consulate?

This is a good bill. The 50% rule will impact Indian bodyshoppers and Top Indian outsourcing companies. But genuine companies like Microsoft,Google, Oracle and other US companies will not be impacted that much as they sincerely search whether US talent is available. But will it pass? In 2007 it did not move as they planned to consider for CIR. This time also same argument may come. But some genuine Indian consulting companies also will be impacted. But system will adjust quickly even if this bill passes.

I do not know how many times this topic was discussed accorss various boards. Because of INA and amended provision in Ac21 act, all the unused visas from Eb1 goes to EB2 and if anything leftover in Eb2 goes to EB3. This is the law. This hurts badly EB3, as demand in EB2 is so high to consume the all the avialable Eb2 numbers. Moreover, country quota is not applied in each employment based preferece catagories seperatly /exclusivly, if the demand in each catagory is less than the supply. So, most of EB2 numbers consumed by India and China as worldwide demand for EB2 is very less than supply. There is no confussion in it. This is the law. Though it is unfair to very old EB3 folks (in their view) One cannot do anything to change it. unless congress rips of the AC21 provission by passing new law.
It is difficult to accept that a EB3 guy in 2001 pd stll waiting and 2006 guy gets gc. But this is what law is, USCIS/DOS can't do anything. If we talk unfairness, there are tons in US immigration. I-94s are submitted at the airport when you leave the country. In many cases there are no I-94s coz they have been submitted and no one thought of making copies of them before travelling out of country. I am sure I dont have all the I-94s that I ever used. I submitted them at the airport when I went out and didnt make copies.

You dont need all I-94's. They only need the last I-94. But, you will need to give copies of all the H1B visa petition. For instance, if you changed your employer then you will have new petition or even when you extend your visa.
