    Just a couple of comments about Heathrow. The mainland of Britain was plagued with the IRA bombing it periodically for decades which forced them to be diligent about security long before the USA knew what terrorism was. Being security conscious has become a way of life on that little island in the North Sea. Just try finding a garbage can on a railway station platform? There are none so the IRA could not plant bombs in them.

    Now about the staff at Heathrow. Surely anyone with eyes that work can see most of them are not British at all but immigrants of some variety or another. A true Brit is a very friendly individual. The invasion of their island during the past fifty years has changed the face of the entire community, not all for the better that is for certain.

    And finally, transit visas etc. If they are needed and that is the rule and you cannot find a different route then it is something that has be lived with. The US had them and still has them for certain nationalities, the UK is certainly not on its own. I have been living in the US for almost a decade now and have been stung by their immigration rules as all of the contributors to this forum probably have but we chose to come here so have to put up with the system.

    We all have choices so if you do not want to get transit visas just choose a route that precludes the need for one. Ten pages bad mouthing the UK is not helping anyone it is just antagonizing those of us who originated there.

    Just because the majority of immigration voice are Indian it is certainly not all and I think that gets missed on so many occasions. We are in the midst of the US immigration system together, or so I thought.

    Every country has its own rules, some will be in our favor some will not but if we choose to go there we have to live by them. It is entirely NOT appropriate to expect countries we visit to bow to us on any level!!!!!!!



    i do not know why there is any bad mouthing of the English frankly...this has nothing to do with the people or even the city in question. my only visit to London was wonderful, i would happily visit again. i would though avoid transiting through Heathrow for reasons i explained. this is a govt policy- right or wrong and finding historical/colonial reasons is silly. it has a lot do with visa overstays as well, as was discussed earlier.

    just to clarify the issue itself though- and trying to keep it to the narrow focus- the direct airside transit visa is literally a run about created to check people that get off a plane at one gate and climb another plane at another gate- in some cases even the same plane! i do hope our british friends at least realise that it is a major pain to obtain visas to be able to do this- and it's not some kind of anti UK stand to avoid flying through LON (and other such airports) that enforce this. in the end it does create some bad feeling- i wish that were not true- but perceptions are fickle things. it's too bad though that everything seems to become about some wounded national pride or historical wrong or suchlike. wish we could all grow up :-)

    btw, since we have some engaged brits listening....is it worth the money to take the chunnel between paris and london? anyone done it? what's the best way to find cheap flights in europe? local insight would be much appreciated!!

    Congrats.. its bit boring to ready through your story though..

    Finally got the CPO emails/texts today morning for both me and my wife.

    Came to USA in 1996 on H1. Masters (F1) from 1999-2000.
    All GC applications in EB2. Nationality : India.
    Applied in Mid 2001 : company (think $15B!!!) went kaput.
    Applied in Mid 2003 : I quit in mid-2005 - while labor pending.
    Applied Nov 22, 2005 : Approved Aug 11, 2010.

    Labor applied via PERM - approved in about 4 months.
    I-140 applied soon after - approved in about 4 months.
    I-485 applied during the July-August 2007.
    Receipt Date: Aug 16, 2007
    Notice Date: Oct 1, 2007
    At NSC.

    Quit in mid-2008 with 485/EAD, sent AC21.
    Got RFE in Sep 2008 (missed the 2008 boat).
    485 LUD stuck at 10/29/2008 forever until today.

    Opened a SR on Aug 5th.
    Took an infopass on Aug 6th - all I could get was, "your application is with an
    Immigration Officer since Aug 2nd". Nothing else!
    Don't know if either had an effect.
    Didn't do anything beyond the above two.

    I think anything that's helpful for anyone based on dates/apps/process/procedures are all listed above. Now for a bit of something in my mind. No particular theme but general rambling....if you so indulge..please continue. Else Have a good day and happy life. And thanks IV.

    It has been a long journey for sure. A lot of my friends who came to
    USA in 1996 are now citizens. I have NO regrets at all. I took my own
    path. Sometimes I used to think that if I had done the GC process
    in 1998/1999 instead of quitting my full time job to do full time masters,
    I might've gotten GC sooner. OR what if I had stuck with the 2003 application,
    sure, it would've taken longer to get even the Labor cleared but I would
    have gotten GC in probably 2007 - and worst case 2008. And heck, I would
    have made an additional $150K (since the company got acquired by "as big
    as it gets" tech company). OR what if I had chosen a very safe choice out
    of masters [believe it or not, I got 12 offers back in 2000 - but then heck,
    every body else got 12 offers as well]. OH btw, the full time masters ended
    up costing me about $45K in credit card loans. So yeah...no point in contemplating
    all the "coulda woulda shoulda"s in life.

    As Nike says: Just do it.

    I strongly believe it was because of the masters that I got the first 2000/2001 company, I got into the next job - and because of it to the next one and because
    of that to the current one - where I am extremely happy and think
    will over time come out very well off too.

    At all times, I never compromised on my job. Took the job which offered
    me the most challenge and allowed me to learn as much as possible while
    working the smartest folks around. That I think was a great benefit - all
    along - since that component of life (work) never bothered me. And was never
    afraid of taking (apparent) risks either. To me they were calculated risks.
    The 2002 company I joined, it was a small startup - I was employee number 20-something and was the only H1-B until we had about 150+ employees.
    When I quit it was 450+ folks and was about 750+ when it was acquired.
    The company I joined in 2008 (via AC21), was and still is a startup. When
    I joined we were 8 employees and still now, remain lean-and-mean but
    kicking some serious ass. (if I say so myself..pardon me). :)

    The biggest hiccup as I think of it now was that my wife was not able
    to work from 2003-2007. But the EAD in mid-2007 finally solved that
    problem. Oh, I never hesitated traveling either : travel to Africa (three
    countries) one year, and to Europe (three countries) one year and
    Asia (two countries other than India) in one year.
    Also purchased a home in 2009 (it was very tempting during the
    2004-2006 times...but waited out for good).

    So yeah...H1-B/EAD/AP are all handicaps - only if you convince yourself so.

    A couple of times I had contemplated Canadian PR or really
    moving there or to somewhere in Europe (and even Aus PR).
    But pursued nothing mostly because I was lazy.

    But all along my wife fully supported in everything I (we) did.
    Be it change of jobs, other big decisions..what not.
    So thankful to god for that.

    Just a bit to go back in the way back machine.
    Long ago, labor was the bottle-neck. Then 485, then something else.
    Things repeat - old is new, new is old...repeat.
    There were times when there was no online checking, no sms, no email notifications.
    Six year h1-cap was strongly enforced. no concurrent 140/485. No one year extension of h1. No 3 year extenstions of h1 after 140. No 2 year EADs. No AC21. No priority date porting. I can go on....but a lot of stuff happened...happens.

    If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.

    A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

    EB2-IC seems in pretty good shape as far as I can tell.
    EB3-folks need some serious legislative help - please consider contributing a fraction of what you send for your immigration-lawyers and get something done. support IV.

    It will be resonable to assume that these will be the dates in OCT bulletien for Eb3-I.
    Finally, 5882 is our only hope for now.

    On what basis you are saying that Oct'2008 PD will be similar to Jun'2007. Didn't you read the note in Sep'2008 VB that PD for EB3 category will retrogress further.

    If you cann't support EB3 community then at least don't misguide people here. EB3-I is in severe pain right now and people like you can't understand it.

    You want to foreclose for a matter of 20K -- I'm really surprised by your thinking process. Based on it, I would assume you had a zero down loan.

    In my opinion and this is my opinion only ( and this is only from a financial perspective only ), taking a hit on your credit report for 7 years for a 20k monetary hit doesnt make sense.

    the moral , ethical part of it -- well there are quite a few folks on either side of it and I'll let them continue arguing for/against it :-)

    I am speaking from experience. Download the forms needed for filing 485, EAD and AP. Then when your attorney send you his/her set ( normally they do this in 2 stages - one they will send you a draft copy to verify and correct all info - some have online questionnaire; stage two - they send the final forms for you to verify and sign again - this they may do paper copy or online PDF - that cannot be edited - not fill able forms).

    So, here I am providing links to all forms that I know are needed. These from uscis.gov site are fill able. Weekend is coming. Fill them, and print and keep them.

    When attorney sends papers, compare yours with their and do corrections in theirs ( usually it will have stamps of the firm)

    Application To Register Permanent Residence or Adjust Status - I-485

    Medical Examination of Aliens Seeking Adjustment of Status - I-693

    There is a supplemental 693 also for vaccination records.

    Biographic Information - I-325 A
    There are A, B, C and other versions. I filled A

    Application for Employment Authorization - I-765

    Application for Travel Document - I-131

    Affidavit of Support - I-134

    I completed all these forms with 100% correct info- still the Paralegal - made mistakes again and again ( I can't correct the PDF as Adobe PDF writer is 1800 USD). I lost ONE precious week. Hoping to file on 06/01/2007, filed on 06/08. Learn and be wiser from experience, yours and others.

    In my opinion, as they are running with these immigration related bills despite the tight schedule and limited time they have on their hands before they go on recess (for election), the chances (to pass these bills) have to be decently high. Otherwise, I doubt if they would put so much time and effort if they know for sure this would fail.

    However, as Pappu pointed out, the success relies a lot on we guys calling everyone on the list to seek their support and counter numberusa or similar groups' attempt to shoot these bills down.

    So, lets call - PLEASE.

    We as a community should oppose major violation done by these consulting firms.
    The only reason these companies send people on L1 is to keep them as bonded labour giving them no chance to switch jobs. These companies can always apply for H1b for such folks, there are enough H1 visas available this year.

    There is a reason there are two visa categories L1 and H1. They should not be used to circumvent immigration laws.

    Been here since 1998. Filed labor in 01 but was revoked due to tech downturn. Filed again in 05. Fortunately my GC was approved last Aug.

    I think the final goal for most folks is citizenship.. including some of those who dont want to stay here permanently. Waiting 15 - 20 years for citizenship makes no sense.. if they are thinking of giving it to illegals in 10 years, whats wrong in asking?

    Just a quick question for current Vonage users.
    Currently I use Phone Power (VOIP, almost same as Vonage). They give me one nice feature called Remote Click 2 call. What it does is, if I am in office (where there is no long distance calling allowed), I login into my phonepower.com account and click on Remote Click2Call. This asks me to enter the number where I am at, and the destination number. So I get a call at my office phone and it connects me to the destination number. And there is no charge for this call.
    Does Vonage offer this kind of feature? and can we make calls to India (under their India unlimited plan) using this feature?

This means each employment catagories are seperatly free from country quota if demand is less than supply in each catagory. If you analyze word by word in the language of the AC21 act, you will understand. Unfortunally (fortunatly for EB3) DOS has not interpreted the law correctly till 2006. Now they are interpreting correctly.
    5) 2/ RULES FOR EMPLOYMENT-BASED IMMIGRANTS-



    (A) EMPLOYMENT-BASED IMMIGRANTS NOT SUBJECT TO PER COUNTRY LIMITATION IF ADDITIONAL VISAS AVAILABLE- If the total number of visas available under paragraph (1), (2), (3), (4), or (5) of section 203(b) ]for a calendar quarter exceeds the number of qualified immigrants who may otherwise be issued such visas, the visas made available under that paragraph shall be issued without regard to the numerical limitation under paragraph (2) of this subsection during the remainder of the calendar quarter.

    In the I-131 instruction:

    "Advance parole is an extraordinary measure used sparingly to bring an
    otherwise inadmissible alien to the United States for a temporary
    period of time due to a compelling emergency. Advance parole cannot be
    used to circumvent the normal visa issuing procedures and is not a
    means to bypass delays in visa issuance."

    If I mention: "I plan to travel outside of USA for family reunion" in the I-131 cover letter, do you think I will got denied because this reason is not "compelling emergency" at all?

    How will you ""On a separate sheet(s) of paper, please explain how you qualify for an advance parole document and what circumstances warrant issuance of
    advance parole." ?

    Let us talk about the "skills" introduced by H1/L1/offshore companies

    a) One guy takes the phone interview for 15 other guys with "skills" they preted to have
    b) Lying on the resume with "skills" that you don't have, so that you can learn the "skill" at the expense of the client
    c) "Skill" in Violating B1 visa laws and sending people on B1 to do actual work to client
    d) "Skill" in violating L1 law which is used to drive down the wages by 20-30%
    e) "Skill" demonstrated by indian offshorers to enter into a contract with a large corporation where they will provide warm bodies in exchange for a very low billing rate. Client wouldn't have any ability to interview the incoming cosultant, which means the offshorer employee is learning at the expense of the foolish client. Then that will be touted as "savings".
    f) "Skill" of fly-by-night operators to shave off 70% of the billing rate through a 6-level pyramid of contracting companies

    Should I add to this list of "skills" further?

    Yes they are very true. Except in f) Generally 6 level pyramid of contracting is financially unviable. Max I have seen is around 4. Beyond that there is nothing left.


    Regarding a) , b) and e) from the client standpoint say a financial company all that they care for is the job being done at lower cost. IT departments are cost centers and management dont care much about cost centers.

    To some extent Obama administration is cracking down on H1B employers abuse.
    Well thats natural when democratic party has control over whitehouse.

    VO doesnt keep your passport if a via not issued at the time of the interview . He gives it back after the interview. Once you receive the email , you have to go the VFS office and then had in the passport.

    But seems to be just laid on table and waiting for action. Specially S.1033/H.R.2330 and S.1916-1919 has a provision to exempt the immidiate family members from Employment based visa numbers which is Good.
    S1438 is also some what for a tiny releif as it asks for recapture of unused visas from past years

    The calculation looks incorrect.

    You considered the I+ C allocations and subtracted those in line 1. You again subtracted those in your final calculation.

    The straight forward calculation is EB2 ROW is entitled to 34,436 (1) and they used 27,406 (2). So splillover was around 7 K.

    All,

    I will once again be writing and sending posters to all the reps. This is one of our chances where we can get closest. If we miss this then there will be lots of uncertainity. Imagine we already missed it. See how desperate all can get.

    We have some time, Lets all spend considerable time this weekend, get bigger charts, use lots of good eye catching color, make our voices heard. Spend considderable time this weekend on this, please. Together we all can make a difference. Please do your best and spread this across your friends also who are waiting or have got their greencards. This one thing sucked up so much energy from so many here. Please support EB2 and EB3. How does one get these greens. I never got any.. :(.
