These are highly stressful times and I am sure people did not mean to create trouble when they wrote such message but rather they were merely venting their frustrations.
We just need to make sure that we're able to convert this energy into some that is positive and useful. Again no offense meant to anyone and no offense taken.

I had applied for my daughter in April. The receipt date is 04/22. Still no luck. I am hoping that we will get the GC as my dates will be current from Ist July.

The flower campaign is apparently working as far as the attention the issue is getting.
If we can manage to send at least 500-700 flowers to USCIS, that will create the kind of attention we want and it will bring the issue of retrogression again on the forefront in Washington DC.

That's ridiculous :rolleyes: So did you pursue with MTR or filing in EB3?
As i said lawyer told me that no use of MTR. We went with EB3 and now i am on EB3 train with I-140 approved. I was wondering that can i re-appeal now after 2 years .

I recently got an RFE to prove that my Master's degree is a three year course (and not a two year program) because the degree and the combined three year transcript don�t specifically state that it was a three year program.
I have three year of Bachelor�s (BSc) and three year of Master�s (MCA) education, which was used to qualify for EB-2. I also have more than 10 years of experience in a related field.
Unfortunately, I only have a combined three year transcript with a list of all the courses completed as part of program (Year 01, 02 and 03) and not three separate transcripts for each year of the program.
I also have an education evaluation to prove that it is equivalent to MS in USA, which was submitted with the original application.
I recently obtained a letter from the University stating that it was three year degree program with year of joining and completing the exam but my attorney strongly recommends on getting transcripts for all the years individually, which may not be feasible to obtain in a timely manner. Project_A - Were you able to file eb2 and got approval after completing online MS ? Also how does uscis treat online MS compared to full time MS for eb2 approval ?

I'm surprised that everybody in this thread got so scared of the language in a stupid bill and stopped thinking how clever Indians are in finding loopholes. I hate when all the extra-ordinary people think in the same direction. To start with, is it possible that these jokers will pass anything agaist the will of big techs like microsoft, intel, csco, think again? even if they did to make average(stupid) Joe happy, they wil keep loopholes making the law irrelevent. e.g. H1 quota limited but L1 unlimited. businesses more than 50 emps can not have more than 50% H1Bs, what do u think big desi consulting cos are in trouble? they will simply 10 more companies each having 49 people.
Other direction: when i came to US in '99 from SEEPZ, my US salary(in Rupees) was 12 times my indian salary, now it's just 2 times. Indian salaries are increasing 10-20% every year, and Dollar is going down (down 20% in 6 years, 40% including indian inflation), very soon there will be no advantage in coming over here, and you are worrying about future H1s having trouble getting GC?
No matter how stupid and selfish politician look/sound they always think about their contries future, and folks these are US politicians. take it easy and take a walk outside, it's nice out there.

My current H1 is expiring soon. My 3 year H1 extension is pending. I had receipt notice but NJ DMV at Wayne refused to accept that. My current License is valid only till the middle of the next month.

Sept dates may advance and some lucky ones are sure to benefit --but for their attempt to use the remainder of visa #s in fiscal year09. Now since most cases are pre-adjudicated hopefully they won't pick up randomly
If we do not see many approvals in August I am sure Sept will open floodgates similar to what we say in July 2008 when so many 2006 apps got GC.

What makes people think that USCIS has preadjudicated cases in the order of priority date. If they have preadjudicated cases from 2005,2006 and left the cases from 2003 -2004 then it is the same mess an d i can bet that knowing USCIS chance of this are very very high so even if your date gets current it is still luck whether you get GC ornot.

"Process" means to open a case the first time, and order they "receive" means when a center enters a case data in the system (this date is close to ND). Until this point, PD has no role to play. Described processes work well for non-retrogressed cases (for countries other than India, China, etc.). If a case is opened, and its all in order to clear except the visa availability, it is called preadjudication. Procedures described (see link below, although they may have changed since), state that once case is preadjudicated, they should be ordered in PD sequence for further work.
