For all those filing I-140 and I-485 for the first time (I.E. No PD recapturing),
You DO NOT need to file I-140 in premium. YOu can simply file the I-485 AS-IS. Actually Right now since everyone is current ANYONE can file for the I-485 provided their Labour is approved. The only way the I-140 approval would help is with the 180 day clock after which the employer has no control over your GC application.
This is what my lawyer had told me when I had asked her last time. Now if the dates were still Retrogressed but your OLD PD was becoming CURRENT, IN THAT case you WOULD need your I-140 approved before you can file the I-485 coz at that time technically you cant file for a I-485 as without the PD recapture your PD would be today's PD and that would Not be current.

Actually, the analysis of numbers and the "math" that you refer to was also done on the prediction threads. So it wasn't really all that useless.

Nurses are part of EB. This nill has many benefits. More nurses will be out of greencard queue leaving others more chance. US has acute nurses shortage. It is well documented. There is not much shortage of IT professionals . Unemployment is so high. But nurses are in demand and it is important for the healthcare of the nation. Supporting the bill is a win win for everyone in EB wait.

USCIS does not process cases in PD order, because they can't. Thousands of files they receive, are sequenced in order they receive them at Centers. They claim that cases are processed in order they receive them. For them "Receive Date" is not what you see on your receipt, it is the date they physically received the case (thus if case is moved from one center to another, meaningful Receive Date is the date it was recieved by the last center). You see this data online status as "...we received (or transferred) your case on ...".
PD critieria is limited to certain countries only. Therefore, by and large, "cases are processed in order they are received..." works well. However, for India, China etc. where PD cutoff has to be factored, it is used merely to decide to work or skip a file (when seen in the receive date order). If PD cutoff date is very restricted, they will have to skip a lot of cases, which slows them down. That's the reason every July they ask for wider PD cutoff dates so that they can consume a lot of visas, as they don't have to skip that many cases.
This process is a mockery of the PD cutoff dates, but that's how it works. If you sent your case on June 28, 07, with July 2, 07 as the printed Receive Data on your receipt, but the case where it finally rested, was entered in their database on Oct. 28, '07 (with a Notice Date soon thereafter), you case will not be looked at, no matter what the PD cutoff date is, unless all cases received before Oct. 28, '07 have been reviewed.
Disagree, the reason you see lot of cases with (older PDs but later RDs) still awaiting approval is because when the PDs were current these cases were still not ripe (e.g: they were waiting name check clearance).
Some of them became ripe after the visa numbers were assigned to cases with later PDs and the visa numbers got over.
There are multiple queues in the system with a backlog at each queue, so some out of order processing cannot be ruled out.
If a PD of EB2-I 2003 is still pending, its because it was stuck in some other queue before it could even be assigned a visa number and by the time it cleared that queue, the visa numbers were all gone.
Bottomline, if your PD is not current, you won't be assigned a visa number, no matter what and if it is current it doesn't mean you'll immediately be assigned a visa number, unless of course your case has cleared everything else. With the reduction in FBI name check processing time and the BECs, one can hope the process is much more streamlined.

hi guys,
The PD current for EB1 in the month of Oct.
I have filed my I-140,I-485 on Oct10 2007 in the category of EB1.
But until now i did not receive any confirmation notice..
Can anyone say what should i do now or have to wait for some more weeks?

It has only been 15 days since you applied. They can take upto 2 months to send you the 485 receipt notice due to the huge influx of 485 applications they received over the past 2 months.

Since you ask - the answer is YES. Not sure if you have heard of the "Servant Leadeship" but that is a management philosophy that believes an organization makes the most progress when the "leaders" at the top take the attitude of being "Servants" to those below them. The idea is based on the simple premise that people are more engaged and motivated to work when their boss listens to them and takes the trouble to keep them updated on what is going on. Instead, "Leaders" can always take the "high and mighty" road where they look down upon those below them (for various reasons - lack of trust being just one of them) but that is never going to be as effective or efficient as the former model I just mentioned. Don't take it from me though - feel free to do your own research on this topic and you will find that an increasing number of companies are starting to adopt this philosophy in order to achieve superior results and you don't have to look far to see how this is being practised in the world of politics today (President Obama)..

Are you willing to copy paste what you have written above and send it to your VP and CEO of the company and ask them to behave like your servants because this is the best philosophy for a company to progress? :D:D
Please also ask them to be transparent and keep all employees informed of all discussions because you contribute your sweat and blood for the company?

Let me share my experience with IV. Initially I did not know much about IV and when my friends said lot of good things about it, I always dismissed them and never came to the site. Then one day I decided to check myself and contacted IV and a core member was nice enough to explain everything. My senior member friends from my town were also helpful in explaining. So I will let them do the good work they are doing. I know I cannot spend so much time on social service that they do. I would rather spend my time on the beach playing beach ball.

Congrats to President Obama.
But, I don't personally agree with the selection committee's decision which suprised everybody including the President. The peace prize should go to someone who have had a track record for working towards achieving peace or the greater Good. They never gave one to M.K Gandhi who deserved it more than anybody in this world.
Make no mistake, Mr. Obama is a messenger of peace but, the fact is that he has been awarded prematurely for something he is yet to achieve in terms of ending the wars, ending nuclear armament, mid-east peace agreement etc (even though I think he will do so in the future).
The peace prize should not be an award for someone's intentions but for someone's actions that follow the intentions.

Dude I think you are thinking too much of it. USCIS is an organization that goes by a process. If they have a pending application, they have to process it. they decided in the summer of 2007 that they will hire additional contractors and process all the pending applications so that they reach their goal of 4 months processing times of 485.
Why will they waste their resources on your $325 dollars again dude? Is the amount that high that they will reopen the case at the time of finally alloting a visa number, and spend the money/resources on reviewing the case again?
Whatever be the PD, USCIS is all set for a month processing time of 485 by Sept 2009. All cases filed before Jun of this year should have been either pre-adjudicated or denied by that date.

I think once an I-485 is filed every one should be equally treated based on their category. If country qouta is based on countries interest, there should not be more applications accepted than within the sitpulated visas. That is not the case here. We have thousands of applications stuck at USCIS. Since GC processing puts certain restrictions on ones ability to shape ones career, it is not fair to ask one applicant wait for more time than other applicant purely based on country quota. We should keep in mind that gc processing effects indaviduals not their countries. So, it is discriminating to make one applicant wait while issing visa's to other person with same qualifications (except that he is from another country).
