The has to be physically present in the US to apply for 485. If she does not have a passport then she cannot file for 485.

I recently got married. My is currently on H1 and is currently in US. Will my wife's I-485 be returned as the priority date is not current I am in EB3 priority date is Mar 2002. Anybody in similar situation as me..please post...
you can not file I-485 for your wife till PD becomes current.
I'm in the same boat. you need to make sure your wife maintains her visa status. Since she is on H1 she should file a labor to make use of 7th year.

Why are you going to other forums for advice. Those other forums are after making money from traffic and ads. They want you to suffer as long as possible so that they make money. My Lawyer said the same thing. If you say the minimum requirement for a particular job is Bachelors + 5years of exp then every person hired for that position in the past should have Bachelors + 5yrs of exp.

Who will be responsible for psychological torcher with less then 50% pay.
Socially isolated coz of not driving.
How one can see the big time loss of applicant.
3 years easily one can wait can say but why for more then 6 yers.
Who are talking time management that didn't applies here.
Who are talking productinve loss for applicant who can earn more then 80k coz of LC approval not who is responsible.
This shows the effect of retrogression!!

These guys did not mention specifically "legal immigrants" but to me that sounds even easier since most of them possibly have decent wages and also maintain a legally sound lifestyle.

My wife recently returned from India and at port of entry, the officer incorrectly wrote the paroled until date as Jul 12, 2010 instead of Jul 12, 2011. The date is incorrect on both I-94 and AP.
Will this create any issues and how can this be corrected? Her status is AOS pending, she doesn't have a EAD or H-visa
My wife's AP is valid till Oct 12, 2010. I would appreciate any help

1. March 31 , 2008 - I am on H4 with I-94=12345..
2. June 27,2008 - H1 got approved with i-94=12345.. valid from 10/1/2008-9/23/2011.
3. Sep 10, 2008 - I enter US on h4 with i-94=abcdef.....
4. Oct 1 , 2008 - Ideally (as confirmed by USCIS, immigration lawyer) , I-94=12345.. should have been in system (become active) and status changed to H1.
But it didn't happen and I-94=abcdef... is active.
Questions:
1. What is my status from Oct 1, 2008 - Dec 31, 2008? H1 or H4.
Since my h1 status was not in system, i didn't get any SSN & hence no paystubs.
2. What is the safest & quickest way to get my h1 status active in system..
a) Stamping in Canada - Quickest for me. Is it safe ?
b) Get status changed without getting out of country? - But how?
c) Stamping from Home country? -- Last option.
Any help will be appreciated.

Just a question.......... I just got my receipts for my 485. When I checked the receipt number on uscis it says that an approval notice for the ead was sent out 2 days ago. Any idea how long it takes to actually get the card??

I don't see any issues for your wife to convert to F1 now and then apply for I-485 when your PD gets current. However once she applies for I-485 then it will be risky to apply for extension of F1 or stamping F1 as F1 does not allow for dual intent and she would have shown her intent to immigrate. So after applying for I-485, it will be advisable to switch to EAD / AP for work and travel.

My wife wants to convert from H4 to F1 for coming Spring 2011 so that she can take assistantship..
Is it advisable to change status to F1 with priority date so close..? does it cause any problems for her I485 application since F1 status is Non-immigrant category..
