I think 1 year or 6 months is anyone's guess. One can always argue why it should be just 6 months and not one year.

A recent post asking about how many people have EB2-India PDs of 2003 or earlier had no responses, so I am curious about the potential spread of waiting people (atleast in the sample set of whoever responds to this poll).

With a few bills introduced or in the works, isn't it the time now to act and bring about awareness to our problems? I know IV has been working through state chapters. We can supplement those efforts with other means such as those suggested in this thread. We need to create an uproar about the hopeless situation and endless wait times due to retrogression, backlogs, and bureaucracy. I am not suggesting anything drastic. Just some peaceful ways that won't offend anybody to draw attention to the forgotten issues of EB immigrants.
I completely agree with you. However our problem is 'how do we organize a massive protest". IV is a loose affiliation of people affected by the immigration problems. They all realize the importance of fighting, however majority of them are unwilling to contribute personal time/money/energy for this cause. Flower campaign was first time in recent history, when legal immigrants showed some unity to express their anger and frustation.
It was predicted that once 485 is filed, people have EAD, and spouse working ... affected people will loose the apetite to carry on the fight. And that's what precisely took place. The biggest chellange is to let the affected people realize that if they do not come out and fight, no one will take care of their interest. It seems everyone is waiting for others to go out and fight, so that they can reap the benefits without any struggle. Now tell me my friend "how do we organize a massive protest??"

Hello there,
I have been wanting to make an IV contribution for a long time and here is my problem..I probably can be labeled a miseror a magpie! ..Whenever I go to the IV link to contribute and see the $50 or $100 option I panic and get out..yes I do!
I have some desi colleagues and was discussing this issue with them at work..and they had the exact same experience..wow..I am not the only magpie..
But hey is'nt IV the one which is at the receiving end not getting our contributions..
I speak from my own experience and call me a mapie or a miser..or whatever..I cant make myself make a $50 or more contribution .. thats the way I am..But I can sure make a smaller contribution (like a monthly recurring $10 contribution which really is easier to make) and I am quite sure IV will benefit from my small contributions as well as i think a lot more people will not hesitate making contributions in smaller denominations than a whopper $50+
And really this is not related to IV effort but more to do with my own way of thinking about parting with my money..I love my money..:)...

In essence, it would seem like the bar was set down.
All in all, we have to remember. IV is not supported by any 'no-nonimmigrant-left-behind' federal program.
If you cannot do recurring contributions, you can do it in one time payments.

I dont think we need to waste our time about such non competent organizations , let them take the credit , it just shows that this was a great idea. Looking at their website it does look like they have some good contacts .
I think immigration voice should write them a formal letter and ask them to publicise this to their "contacts" ..

When there is a overflow, I strongly feel that it should flow to all the categories and that is called equality. Some inefficient people in Decision making authority at USCIS framed a rule on visa overflow and they are following it. If the rule is not much logical/ethical to most of the people, then anyone can voice their rights against it.
Just for example, a team consists of one project manager(EB1), two tech leads(EB2) and 6 Developers(EB3). The demand is based on no. of vacancies exists on the market, that means a lot of EB3, less EB2 and few EB1.
As per this rule, USCIS is not actually feeding the hungry.
Regarding the country quota, US is not favoring/helping the foreign countries by giving GC to those people from them. So, it makes no sense at all when it comes to immigrants but I can understand the bureaucracy behind it.
If they are implementing the country limit then it should be like 0.00001% of that country's population, I feel.

How about tourist visa? you can get multiple entry for 10 years, but I guess no of months you can stay in India is a question. I am applying for my son too, both of us hold Indian passport, what you guys suggest? go for OCI?

- front and back of current EAD card

What makes people think that USCIS has preadjudicated cases in the order of priority date. If they have preadjudicated cases from 2005,2006 and left the cases from 2003 -2004 then it is the same mess an d i can bet that knowing USCIS chance of this are very very high so even if your date gets current it is still luck whether you get GC ornot.

If a case is opened, and its all in order to clear except the visa availability, it is called preadjudication. Procedures described (see link below, although they may have changed since), state that once case is preadjudicated, they should be ordered in PD sequence for further work.

Since USA home land Security depends on Legal immigrants bondage and slavery .. ..I mean fees they pay to stay in this country .. Amendment to File I-485 with out Visa being Current should pass easily. That way EAD reneavals will keep USA Govt running ..

As such, Canada does not really have as many jobs as in US. Offcourse it is a fact that PhD and Doctors drive cabs in Canada because they can't find jobs, but someone who is not a US citizen finds a good job in USA because it is simply the land of opportunities.
I am not saying points system is the best, but opportunities play an important role and thats why US has so many jobs compared to other countries, though so many jobs are outsourced. There is always growing demand and the economy is huge and accomodative.
Canada on the other hand is still slow to add jobs it the pace America does because of the lack of infrastructure (As I have not been in Canada, I don't have much information on how things work, but I know for sure that getting jobs is very difficult)

Canada on the other hand is still slow to add jobs it the pace America does because of the lack of infrastructure (As I have not been in Canada, I don't have much information on how things work, but I know for sure that getting jobs is very difficult)
We must have a seperate thread on merits and demerits of points based system over the existing system and the issues being faced in countries like Canada etc..

One of my friend asked Shiela Murthy and she said that in order to be able to add my spouse , I would have HAD to get married before July 31st (which I couldn't anyway), because, then, only I/we will be eligible to add my spouse.
Also, I sent in the papers for my I-485 last night. Now, hoping to god that there is an RFE on this and some kind of delay.

double-check that note from Sheela Murthy (take an appointment with either her, or Rajiv Khanna). You have to get married before your 485 is approved, dont know whats that July 31st date. Good thing you filed your 485 atleast. You can add your spouse only when your PD is current, but you can atleast use AC21 in the meantime (for changing employers etc).

To summarize the INS position, as long as the principal applicant gets married prior to the INS' approving the I-485 application, there should be no problem for the dependent/s to either file the Adjustment of Status, if in the U.S., or to "follow to join," based upon a consular interview abroad. Therefore, the principal can file the Adjustment of Status application prior to marriage, but the marriage needs to take place before INS makes its decision on the I-485 application.

I am reading a lot of information posted on this form thanks a lot to every one.
But I am still not clear if I can apply in EB2 (PERM) as the job requirement says
Minimum of 5 years programming experience
But is really important to SAY THAT�S MASTERS DEGREE PREFERRED,
Because I have Masters in computer science but the job requirement does not need it.
To apply in EB2? Or just BS+5 years of experience is good enough
