Happy diwali to the many IV members who celebrate the festival of lights with joy and happiness.
On this wonderful ocassion, lets all look back at what IV has done and continues to do as an organization. Lets look back at the July fiasco and how IV members united for a cause. Look at all the legislative efforts IV has been working and continues to work for our cause.

There is one more option for you. H1 and L1 employees can go on long paid/unpaid leaves. If her company can support with document that she was on an unpaid leave for any reason (I do not know the reasons...make something) then there are chances that she will be able to change her status back to H4. All you have to prove that there was a good faith employee employer relationship for that particular duration. Talk to a lawyer, explain the situation..........every passing day is making your situation worse. Good Luck.

Hi, me and my wife we both r on H1b. My wife works with a solution & service LLC.say company A, now the owner is ready to start a new company, say B,with my wife as partner. She will be just passive investor in the company and getting profits, if any from company B. Can she still work full time with company A?. How can we invest in company B and take profits. What r IRS forms?. Finally any good attorney suggestions for Houston, TX.

May be some one who has already renewed their AP can answer this:
I am about to renew my AP. What will be the start date on the new AP. Is it the date after the current AP expires(like with EAD) or the date the renewal application is approved. Appreciate any responses.

How can just copy of 140 approval enough. In order to port I think you need job title and description...
He is talking about porting the "Priority Date", for that all you need is I 140 approval notice.
What you are talking about is "AC 21 portability" and changing jobs using that portability: for that you do need details of job title, description etc.

Your are definitely a EB2 worth candidate. A company willing to support you and a good attorney is all you want. There are plenty who have qualified for EB2 with these qualifications.
Instead of MS, look for a good consultancy or a perm job which will do the trick for you. I do know/understand that it is hard to get consulting jobs and maintaining visa's for family members but look at the bright side, labor nowadays takes only about 3 weeks and 140 if you apply through PP, then you are talking 2 weeks again. You have a possibility to get out of this mess.
If kids from college gets into EB2 and gets GC in two years, You sure do sir...
OK now to members who think I am wrong can bash me but this is what I believe in, if a system can tie you down with stupid rules and no accountability on its workers, I am ok with a deserving candidate cutting the line ahead and getting his GC. Hail common sense.

The reason the processing dates matter is because by the time USCIS gets to process our I765 and I131 the dates would have retrogressed and then what happens is a million dollar ?
What is your point, Tnite? EAD and AP can filed/issued even if the PD is retrogressed. MY PD was retrogressed after I filed I-485 and EAD and AP were issued?

Shop lifting has to be the most cheapest crime our indians commit when they land here.. They think the stores dont have anything and try to put it in their pocket and go away..
This is not an accident. there is no justification for what this guy has done. but maybe he can be given a benefit of the doubt that he did a stupid thing, in the rush of blood. I dunno if he inadvertently tried to put something in his pocket , forgot and left the store...if that is the case the guy deserves a break...
if not i cant fathom the fact that a sane person who took so much effort to get here thro F1 or H1 or what not, had this cheap idea... :eek::eek::eek::eek:
I read in one of the posts that they forgot to bill that item and could have been caught. Most cases if u are buying so many items and miss one they will leave u...

It's just bad luck to get that kind of CBP officer. It's upto you to ignore this or escalate it. In my opinion behaviour of CBP officer was wrong.
