Letter writing will be useless. USCIS wont give without a fight. You have to see from their point of view. This open a can of worms for them. They will never yield unless forced by court.
I think USCIS is not the one who decides not to use wasted visas. It should be Department of State. As per my understanding USCIS "returns" unused visas back to DOS.

I recommend that they approach "future-tellers" and astrologers forum than raising that question here. Given what everyone is doing "speculating" and "hoping" the people on those forums (astro) are better at that :-)

I feel sorry for the people who live in slums of dharavi but not for people who should not have been in the US in the first place (based on their education) and are now finding ways to get ahead of the legit EB2 candidates by buying masters degrees.
They are NOT buying MS, they are inquiring where the fees are cheaper. If this is buying MS, even you *bought* your Masters (and every other degree) unless you are from the 1% who get full scholarship (you would definitely have been in EB1 had you been in that layer).

Project_A - Were you able to file eb2 and got approval after completing online MS ? Also how does uscis treat online MS compared to full time MS for eb2 approval ?
I also have 3 year degree+1 year PG+ 20 years progressive experience. how can i get approval under eb2 ? I heard that uscis is now stricly looking for 4 year degree for all eb2 approvals.
No, we do not have any suitable open positions to file under EB2. There is no difference between online /fulltime; in fact even fulltime students are allowed to take online lectures (for example if they are sick and could not attend). Hello Guys,
I need your advice here. Six month ago i joined one of the many blood suckers -Desi cosulting company in new jersey. As you all know, they ask me to sign their contract in which its mention that if i leave their company before 1 year then i need to pay them 15k. Thy also charge me 3k for my H1-B which i am still paying everymonth from my paycheck and we have 70/30. In just six months i am so much fed up with them. These people are so rude...always show their arrogance over phone. I have no libarity to find job by myself. They always looking for higher pay rate sp that their big money tummy get filled up.and i also feel that they didnt told me the right pay rate for the project i am working on right now.
I really want to leave them, Even before 12 months. Is there any importance of that contract letter i signed with them?. Can they Sue me? What are my options? Please suggest me.....i am in stress.

Leave them. they can't do anything. just make sure you get your last months salary into your account. point to note that once you see you salary into your account its take around 2-3 more days to make the final transaction into your account.

Correct, there are problems with the online status with TSC.
My AP status say pending since 10/04/2007, I got my AP documents from attorney this afternoon.Still the status says pending.

Is there any Specific date, I mean when AILF is filing the case...USCIS is announced they are gonna reject the applications..but did they rejected any single application?? We will come to know after 4 or 5 weeks abt our applications (As per USCIS rep)....I think there must be some time limit to file a case...and we dont have a base to file a case until they reject it.
Finally they dont reject application nor they will accept it...
Guys send flowers with all your comments on JULY 10TH...we may get media and political atten...

EB3 is not working, because we have no hope, not because we all went back or have ported.
Say only EB3 India. not whole EB3. EB3 ROW have no problems.
If EB3 India have no hope then why do they visit forums, check visa bulletin every month, ask questions if something is going to happen?
Should they be stoppoing it and forgetting greencard if they have no hope?

I have followed it up with AILF and 3 more attorneys just in case to see if a law suit is feasible. All of them said, it is not possible. Only option left is to write to Dept. of Justice to see if this law holds a constitutional test. I wrote once, but never got any reply on that.
But if we could take this as a group and mobilise on a mass scale to reach out to DOJ and have them review this INA law we might get attention.
Couple of points to Nay sayers.. that this is not racial descrimination
INA even though uses country of birth instead of color of skin It is still considered raical because, Under the same INA, if someone is born in a retro. country and their parents are not from that country, One could use parents country of birth.
So if a family from UK on a business to India gave birth to a child, this child is not subjected to India limits. Which means this applies only to natives from India.
I tried explaining this in my writing to DOJ. But one letter didn't do the job required.
