    For my part, I send an email everyday to the white house and the state dept. This is probably not enough.....but may be some day it will work.

You make others also come and push. So, how many people were you able to convince to do what you did.. Dont just convince them, make them also spread the message.

    I know some people do realize things only when they loose their jobs or when its too late. If realization happens only that way, I wish all of you those not participating actively loose their jobs and hence comes realization that will help you and us all. Hope that happens very fast..

    The rough estimation is about 500K to 700K new 485s and same amount of EAD and AP applications will be filed in July.

    1. ARE YOU SURE THIS NUMBER IS ACCURATE? 700K? SEEMS TO BE EXAGGERATED.


    When they took inventory in May, there are about 40,000 documentarily qualified 485 applications were pending due to non-availability of visa numbers. The �documentarily qualified 485 applications� mean the application filed long time back and processed by USCIS and cleared the FBI name and criminal check, and found eligible for green card.

    2.IF THESE 40K WERE OTHERWISE QULAIFIED WHY WERE THEY SITTING ON THEM UNTIL MID-JUNE ....TO START WITH? IF THEY WERE SO EAGER TO FOLLOW THE OMBUDSMAN'S GUIDELINES WHY WERE THEY SO SLOW IN USING UP THE VISA NUMBERS UNTIL MID JUNE?

    However, the available visas are more than 40,000 (60to 70K). Then they made with out consulting properly with USCIS they made �current� for all EB categories. This is how they determine �current� or �over-subscribed� and how they establish cutoff dates.

    3.MORE PRECISE DESCRIPTION WOULD BE THEY WERE COMPLETELY RECKLESS..GIVE A S+I& ABOUT HOW MUCH THEIR ACTIONS AFFECT THE CUSTOMERS.


    For example, an EB3-Indian whose LC approved through fast PERM on July 30th 2007, can apply 140 and 485 on July 31st 2007 as per July visa bullet. For his PD, it will take another 10 years for the approval of 485. During this 10 year period, he/she has to live in EAD and AP and need to go for finger print every 15 month.

    4.OK..... WHICH PART OF THIS AFFECTED THE STAFF AT USCIS... THE FACT THAT MANY OF US WILL ONLY HAVE EAD FOR 10 YRS OR THE FACT THAT MORE EAD RENEWALS MEANS MORE CUMBERSOME WORK FOR THEM? I'M AFRAID IT IS THE LATER.

    Now, they used all 140K visas this year.

    5.AREN'T THEY REQUIRED BY LAW TO SPREAD THE NUMBERS FOR EACH QUARTER? DON'T THEY HAVE LIMITATIONS ON HOW MUCH THEY CAN USE FOR EACH MONTH ETC?

    The constructive approach is getting an immediate interim relief by legislation to recapture unused visas in previous years to balance the supply vs demand difference.

    6.I AGREE. THIS COULD BE THE ONLY >POTENTIAL <SILVER LINING. HOWEVER, OPPONENTS WHO FOUGHT THE PREVIOUS LEGISLATIONS IN FAVOR OF US WON'T LET IT HAPPEN THAT EASILY.

    THERE IS NO OTHER CHOICE OTHER THAN TRYING..

    I was under the impression that 10 - 15 days gap or 1 month gap can be justified as vacation or sick leave as long as "employer - employee " relations exists (not terminated by the employer). One whole year cannot be justified under this.

    What would you do if no one is calling for an interview? It is not like I didn't managed to get a job. Nobody called me for an interview. At least, the Desi consulting company that I have joined, didn't managed to arrange an interview.

    Only 67 members so far? I was thinking there would be hundreds of FOIA requests by members, if not in thousands, given all the tracking activity/VB predictions that happen here (and else where too). Now that finally we have a way of accurately predicting PD movement in Visa bulletins and make more accurate prediction of approval than possible through any tracker ( all of them limited to insignificant percentages of the total population to make accurate predictions), just by sending a simple letter; I am baffled by the lukewarm response by a community that's otherwise relentlessly peristent in the tracking/predictions activity.

    Having too much fun in those vodoo activities, are we? Welcome to the real world. FOIA is our chance to get the answer we all have been seeking. Will you pop the Red Pill? or continue dreaming in the unreal World of tracking and VB predictions?

    Guys....like everyone else I have been doing exhaustive research on this subject for last month or so.....I have resigned this week from my job and have decided to use AC21...... following are answers to some of your questions...

    New Employer support - There is no need for the new employer to support the GC process.....After you file 485, the process is yours as an individual and not of any employer....All you are saying is that my I-140 was once approved with some employer and USCIS took forever (read more than 180 days) to give me my green card......so as long as your job is in the same profession (read occupational classification) you are okay....so NO, the new employer does not need to support the process....all they have to say in the employement verification letter is that we intend to hire this person on permenant basis after getting his Green Card...... Please read Yates Memo of 2005 and it will tell you all there is to know about AC21.....

    Lawyer Support and Expenses------- I can imagine lawyers trying to make whatever case for asking whatever ammount of money for AC21 as that is a new business area for them?----- I do not think you need a lawyer for this.....there are plenty of letters on the net that show the template....also, if you are sure your employer is not going to revoke the I-140 then you are not even required to send the letter untill if and when USCIS asks for employement verification letter.....

    As per charges from RK and Murthy...

    Rajiv Khanna - $3000 for primary +$1000 per dependent

    Murthy - $2000....

    I have done some exhaustive research on this AC21 crap and have decided to change the employment......

    You are wrong. New Employer has to support GC.

    Since GC is for future employment, there should be an employer willing to hire you on the day 1 you got your GC. AC 21 helps you to transfer the burdon from one employer to other. In most cases, by providing an employement letter for a permanent job in the same or similar job, it is kind of implied that the new employer has assumed that burdon without themselves knowing it. It would help your case, if the new employer explicitly say that they acknowledge your pending 485 and would assure USCIS that they have a job up on approval 485.

    I agree with you totally. But the sad part is, Try going the normal straight way & nobody entertains you when the companies hear the word "H4". All the work experience gathered over the years suddenly seems like crap in front of the visa status.
    Its frustrating.

    Yes. Many of the American companies, the fortune 500 companies would go without a qualified worker for months and months but would not hire H1B because they dont want to deal with keeping track of stuff and all the legal requirements and paperwork and dealing with USCIS and immigration lawyers.

    But you have to start somewhere and gain experience and hope that you will have a project somewhere, where you prove to the client (potential employer) that you are a valuable resource, and then they would sponsor you for H1 and then you can quit your desi employer. That is the standard M.O. for most people who are looking for a start. However, in most cases, since desi employers are also the GC sponsors of the primary bread-winner of the family, that opportunity of working for a better employer is passed up by many employees.

    You can also use Mental Rey, and check the "final gather" option. Make sure when you use it you set the rays down to like 10 or 20, or it'll take forever to render.
    This will actually make all objects emit a certain amount of light depending on their brightness. For example, a stone wall will not make any noticeable light, but a bright white ball (a light bulb) will act as a omni light. I use this in almost all my renders to achieve a more realistic scene.

    That shader glow thing isn't what he wants I think. To add it though, open the attributes of the material, and under the special effects menu you just increase the value from 0. That does not make the object a light though, it adds a glow to the object in post (after the render), and so it does no make any actual light. .... i might be thinking of some other glow thing, soulty's way might work as well

    You are correct. I joined the new employer on H1 B transfer. I didnt use AC21(ead)to work for my new employer.
    Nowhere in this post, do I see the fact that the OP used AC21 when he moved in August 2007.

    Does not AC21 come in when you have used EAD to move instead of a H1 transfer?

    In my understanding, by doing a H1 transfer rather than invoking AC21, the OP preserved the status of the original petition unless the employer revoked the I140 for fraud. If that's the case, shouldn't the RFE be worded differently?

    If that's not the case, all the OP has to do is craft a response to the RFE with an Employment Verification Letter from his current employer attesting to the similar nature of job etc.. and move forward.

    Either way, an attorney would be the safest bet..

    I agree that with apinto and gooblywoobly that risk assessment should be done by everybody. risk calculation can be best be approximate. But most people paint the best case and leave it there in order to enjoy material comforts.

    When the adversity strikes, people write long stories without a moral at the end. The moral of the story is don't sign up for heavy loans and mortgages, when you are a temp . That's not your venture (risk) capital that you can just burn up like startups did in the silicon valley and ruined it.

    Yes, immigration sucks but this is not a moral of the present story. If you make a film like that,where you are skating on thin ice, folks will laugh at you. Make a better film which says you can't buy a house or invest here, even if you can afford it and you cannot accept job promotions or change jobs due to restrictive immigration policies.

    And yes, if you leave your cars and your houses behind and run off to home country with your tails between your asses, you deserve to be extradited and put behind bars. You know why. My companies has high paying financial institutions as its customers. They have slashed their IT budgets due to folks like you (loan defaulters) and now I find myself going several rounds of layoffs, despite no fault of mine. Its making me loose my sleep.:mad:

    Please just dont worry about it too much , there are also chances that you may not get an RFE. There are chances that you may get an RFE but you dont know what USCIS will ask from you. You need to have RFE in hand to prepare response for that.

    I know that I may or may not get an RFE. I just want to find out if any of you guys are in the same situation. I am sure that some people didn't worked due to the economic situation during 2000-2001. Since I am not entirely sure what should I do if I get an RFE, I just want to find out. If the IO ask me for a proof of work, then I may not provide it. I don't have w2, I didn't filed tax returns, don't have pay stubs; not sure what status I was in at that time. My i-94 was still valid, but I just didn't worked during that time period. If IO ask me to provide w2, I simply have to pack my bags!! :eek:
