    Its probably part of an investigation of your employer. Maybe they finally decided that it wasn't necessary to interview you. But probably best to get back to that guy all the same; talk to ICE directly too.

    this is a valid point.

    but advantages of CP vs AOS are completely besides the point as that decision is based on individual circumstances.

    If you/IV want to lobby, lobby for EAD/AP for the guys whose 140 was approved and staying in US legally on a non-immigrant visa. This may be possible thro, USCIS regulation w/o law change.

    Most of the July filers have 140 approved and working in a full time job.So I think there will be little impact.
    thats not necessarily true, there are lots of people with consulting firms including myself, however these are big consulting firms with 1000+ employees. I see fewer applicant from smaller companies.

    Guys give it a couple of days. You'll start getting the receipts soon. Yes they are working on July 2 plus before July 2 mail. In another couple of days all their personnel will be working full time on the hundreds of thousands applications mailed in July. So be patient. It will happen....

    I have been resisting reading this thread until now. Had a gut feeling that something with such an idiotic title cannot have anything meaningful. Anyway, just read this and couldn't help rolling on the floor!

    So basically this crackpot "rajakannan" files in June and tries to con everyone into applying on July 31st, thus ensuring two things (IMHO):

    1. USCIS won't delay sending his EAD and AP due to deluge of I-485 applications.
    2. In case the dates retrogress middle of the month (mid-July) due to large volumes of I-485s from people (from other countries or those who don't visit here), then that reduces additional backlog for his case.

    Good job, "rajakannan", you have only managed to insult your intelligence by starting this thread. Members/Visitors here have noble intentions and hearts of gold not to wish bad things for your I-485.

    Crawl back under your mushroom and don't ever come here again.

    hey guys I think its OK now to call IV as Indian organization with this bulltin and per their statement there is a good chance that ROW will move ahead and we will be stuck EB3 India in particular

    If you don't stop saying comments like this, you'll totally alienated people like me. It is a global issue, doesn't matter where you are from. People from all nationalities are affected. Oh guess what, it wasn't just Indian nationals who saw no movement.

    Or, if you truly feel this way, I'll take my donations elsewhere, and I'll stop meeting with lawmakers on everyone's behalf.

    Your logic is beyond me. On one hand you seem to disagree with the practice of labor substitution but on the other hand you are more than happy to provide the recipe for it. Are you for it or against it. Or may be you are just trying to help an IV member.

    It may be legal but should be discouraged to say the least.

    I dont like that practise of labor substitution. Its unfair to everyone who cant do it, which is like 99.99 % of people. However, I am saying that its legal because it is. But by saying its legal, I am not saying that I am glad it happens.

    If every one of labor petitions out there coming out of Dallas and Philly BECs are up for grabs then the priority dates will never move forward as newer employees keep getting ahead of those who are stuck.

    The reason I am advising this guy is because I dont want him/her to get trapped at an employer where he is in a vulnerable position. I know this kind of employers very very well and they are inhumane (understatement). These are the guys who would make Jack Abramoff and Tom Delay look like ethical saints. You get the point. That is why I am saying that you need body armor when dealing with this kind of employer. That is why I would like this fellow to get his own immigration lawyer to handle everything so that HE/SHE has visibility and control, otherwise he/she is going to end up getting GC even after all of us have our GC after retrogression is over .

    Its all about ratings. Fox is beating CNN in viewership levels. CNN has thus found a niche following for anti-immigrant issues (a conservative matter) and through which is hopes to direct some viewer numbers to its side.

    Guys,

    I am also in somewhat same situation. So thought of sharing it in this thread.
    I am also single and filed 485 in July 485. My PD is Dec 2006 under eb2. At present the EB2 dates are June 2006. I am carefuly waching the dates every month to pull back my application if my Eb2 dates becomes current to my PD date.

    But this question often hunts me...

    1. If USCICS apprvoes my 485 by mistake while my PD date is not current, can I let them know about it and get the 485 approval cancelled or is it irreversibale...??

    2. HOw long does it take to notify USICS to withdraw my 485...??

    We are not sure of the chronology of events such as your wife's pregnancy, Your job change, your insurance start date. If you guys had individual insurance before your wife's conceiving, insurance cannot deny coverage as pre existing condition. Make sure you put these events in a time line and rule out the possibility of coverage. if you have done so, you have to explore other options.

    As far as changing job is concerned, make sure your job requirement matches the same and similar concept. If you have used AC21, why not use it one more time? Of course, your PD and other personal issues might be stopping you from doing so. But if you are just thinking about using AC21 again, dont worry. Talk to a good attorney and drink the kool aid again.

    The easiest way to get through this is to get under group coverage. I will let you know if there is any way you can sneak into group coverage. but the one I can think right on top of my head is joining an employer with health insurance

    Why can't garbage be thrown in Walmart shopping plastic bags?
    It doesn't make sense to harm environment even more by buying new things.In fact, there are new trash cans available whose upper mouth is designed to fit in shopping bags itself.
    Regards photos-Let's say you save $20 by saving on photo. You can put this extra $20 in bank @rate of 5%. or you can spend it on extra dinner/movie.
    Both options will still rejuvenate economy.
    If you send saved $20 to India-Indian govt will be happy to reduce its oil import bill by $20, your family will use this $20 to buy a new Motorola cell phone/Nike shoes or eat dinner at MacDonalds.

    my non-lawyerly suggestion: do not file ac21 until well into whichever job you takel

    I have read on various forums that there is no necessity to notify unless there is an RFE, but to maintain appropriate evidence at all times. you may want to consider doing that until you are well settled in whichever job you take.

    by the way, what is your PD?

    I have a pending AOS (I-485) application
    filed by my previous employer (company A). The I-140 is approved and is well
    past 180 days. I moved from company A to company B in late April
    2008. They did an H1 transfer and filed for AOS portability under
    AC21. I did not like the role there, so had planned a move to Company C, my current employer - again H1 transfer and AC21 (yet to
    be filed). Just before I moved, I got another offer from company D
    (which I believe best fits my long term career interests). I would've
    avoided the hop to company C had I not given the notice to leave at
    Company B. Now, I am looking to move to company D at the earliest (perhaps in a month). I have
    been at company C for 4 weeks now.

    Question:
    Should company C file an AC21? Since there is already an AC21 on file (by
    company B) and if I will move to company D, can I reduce one additional AC21
    filing? This is just so that there aren't 3 Ac21s filed and to avoid
    making me look frivolous. Please advice. If its safer to file it, I
    can request an AC21 filing soon from company C.

    I always wonder and think what we do more that cannot be done offshore in India. As a business owner you are always concerned about bottomline. I work for IBM and I am on short assignments at different client locations, during early 2000s some offices used to have exclusive american staff (or should say white) then it was Indians on H1 Bs and now there are more Indians in offices than americans and if I check who they are, 90% of the time they are on site from a outsourcing companies. So I see that as a trend. As a CIO you got to wonder if I employ 90 out 100 of my staff who are high skilled Indians here why cant I just go to India and get them for cheap and tell my fellow CIO buddies how I saved money and how they should also do it. So it is a combination of cost benefits and chain reaction.

    Even I feel what I can I do which my fellow Indian in India cant do, since considering we went to same school etc. It is not like we are inventing rockets here we are all intelligent people to some degree and hard work is part of our blood so if I can do it I bet my neighbor can also do it.I think it not far when everything repeatable will be moved to India same as why you do not find very many americans laying a optic wire cable or digging a road, but almost 100% of the time the optic fibre company boss is American and usually white.

    I understand CIO line of thinking ...he may see all indians around and think of offshoring ..but he dont realize the desi consultants are here through a preferred vendor who might be american who is getting business through this placement and he might be employing one american and so the chain goes on ....But when he says to CIOs and every one start doing the same ..then after some time the Job growth decreases, so is consumer spending ...And as a result ,this CIO may be layed off ,as a part of cost cutting measures and Outsource his job too ...:D

    At the same time i dont know enough to take any side between free trade and protectionism....
