I think this has a better chance than rest of other EB bills, because US wants more skilled persons and by defintion advanced degree holders from US in STEM are. Congress extended 20,000 H1 visa for US masters and PhD graduates some years ago whereas they were and are loathe to extend the total H1 numbers.
Going by this logic, I think this bill will go farther and gain traction. Lets's keep our fingers crossed.:)
In one stroke, this bill helps both a) US advanced degree graduates and b)non US graduates (i.e, EB applicants), as 1) it puts EB1 and EB2 in non quota category (I,C,P,M and ROW) and 2) frees up EB1 and EB2 numbers for EB3.

You can't. No lawyer will do so as this is fraud. If uscis is able to track it down, ie: they kept the envelope, then such a person is in trouble.
You think they will go thru thousands of applications and check the tracking number? Besides I don't think they keep the original mailing envelope. So I think asking us to keep the tracking number is just BS.
USCIS is already making contradictory statements. First they release an update that they have processed all applications mailed before July 1 but when I call customer service and tell them that my application was mailed on June 11th, they say wait for 90 days.

Very interesting:
They say that they will run Master's cap first, then put the leftovers into regular cap lottery pool. But it would be better for master's degree holders if they did it the other way around!
We know the master's odds are better than general pool odds. Maybe about 50% vs. 25% this year.
Think through the math! It would be more advantageous for Master's degree holders to go through the general lottery first, and only if they lose in general be put into master's lottery. Maybe there would be less than 20,000 general lottery losers with advanced degree, then there would be no need for another lottery, they would automatically get the 20,000 that's allocated for them.
Is USCIS trying to screw Master's holders on purpose, or are they just bad at math and screwed them due to ignorance?
The spirit of the whole master's cap law is to give master's holders an advantage. USCIS had a choice here of giving a small advantage (master's lottery first, then general) or big advantage (general lottery first, then master's) and they chose the smaller advantage.
The whole fact that we're here thinking about the odds, just like horsebetting, is of course ludicrous in itself.

amitjoey, Thanks. I have sent a request to my senator yesterday and also mailed them all the copies of the documents. Just hoping that will also help. I was told that my file is already assigned to an IO and you will soon hear from USCIS. "Soon" in USCIS dictionary seems to be 30 to 45 days and thats very scary s that means it will about 130 days. I am just hoping they will approve soon. After approving it seems they are taking additonal 30 days to print the card.

We just received news that the Judiciary Committee hearings which were supposed to run until 1.00 pm today and also tomorrow have been postponed to March 27th. Apparently the deal is that the Judiciary Committee wants to put pressure on Senator Frist so that he does not introduce his version of the bill bypassing the committee...

The truest gem is this other line: "In the unlikely event that DHS receives actionable information after the application is approved, it will initiate removal proceedings."
So all they were waiting for these unlikely events to happen while they kept hundreds of thousands of applicants in the deep freeze at USCIS?!

I suggest you wait and see if you can reconcile your differences......Marriage is a life long commitment. Remember we fall in love and we work on our marriages. Thank you very much Dinesh for this. Currently my spouse's passport is stuck in the same place for god-only-knows-what reason. The embassy staff said they are auditing every 2nd-3rd application. We have the AP but we were thinking that if we withdraw the H1B application, the embassy people might stamp the passport saying "Application Received" which sometimes can be a euphemism for "Visa Denied". I once got such a stamp when visa was denied to me.
Since we would then always have to keep explaining at every stage why we have that stamp, that's why we are sticking on with H1B delay. We have been given the same time-frames as you were.
When you withdrew your passport to travel on AP, did they stamp your passport with any text? Also could you please tell us the procedure you followed to withdraw your passport and whether you could collect it in person? We have been asked to email the US Embassy for withdrawing from our H1B application.

your degree certificate changed if you completed your degree in 2000 and gave some supplimentry exam in 2002, so you did not get Degree Certificate in 2000. You got it in 2002. That makes it 2002 Degree Holder and not 2000. That mean whatever supp subject you are saying was mandatory for Degree Completion.

Who told you that you will get EAD/AP in three months. Nothing will prevent USCIS to develop backlogs in EAD/AP too now. "Oh there were so many filed in June/July so that we can't process them that fast anymore...":cool:
