Spouse working - Yes, in theory they could allow H4 to work. However would that be any job? If so then the H4 would actually be far better off than the H-1B who is restricted by job category and employer qualification

if your PD remains current for at least three months in a row and everything else is clear, there is good chance you are out of the pipeline.
My PD is current for almost a year and Name check is cleared in July 2008.

I understand the pain of dependents. My son is also will be aging out.
Ability to work comes from EAD which would come from filing of 485. July 2007 filing was pushed mainly by IV and only then other organizations have pushed for it. I hope you are aware of this. 2 year EAD is IV's achievement.
All this happenned due to IV members and dedicated IV core. The president of this site IV is not a GULTI, but an Indian who donated about 60,000.00 US dollars. Yes, US $ 60K. He is also just like you and me. Never thought of divisions among immigrants: Neither Indian, Chinese, Philippines nor any origin. We have members from all over the world. The majority unfortunately is from India due to severe retrogression.
Had president of IV not donated 60,000.00, majority of us would still be struggling for spouse to work.

My daughter has received her new US passport. Her Indian visa is in her old passport. I understand she can carry both passports with her to India and does not need a new visa. Am I right? Thanks.

While waiting for GC ( which may take several more yrs !!!) I want to go for Life Insurance, Since I am at age of about 40 its need to be done, though I have enough of that in India, not in US. In that regards I just started evaluating different options. Plesase share your comments and experiences during search of Life Insurance.
(1) which is better to go for term life or whole life
Term Life is better , agents will push for whole life as the commission are more
You have to come to the term , till when you need life coverage, like your son graduating after 7 years or after 12 years you may not have financial liability towards kids etc
(2) I started contacting agents (mainly desi) and they recommend Whole life ( if you can afford premium). They tell that it is ultimately result in Saving, Dividend etc. So my question is Does paying EXTRA PREMIUM ( i think it will be substantially high for whole life) RESULT in EQUIVALENT OF SAVINGS OR DIVIDENS? or just agents recommends that because they get more commissions with that?
Yes they get more commission on whole life , basically you dont need , if at all you think then you can go for term life which offers extension after the initial period with same premium
(3) I see lot of DESI agents in New york Life, So is it due to their speciallity in Indian Community market? Does they offer competative products?

Any Idea on how to get money from India from my own account to which I have sent from here.
I am in the other way round,Last year i bought a house in india and i keep sending money to india as soon as i get my salary deposited everymonth. Lot of my friends are in the same boat,we send all our savings to india. I send not less than $3 k /month to india and can try to help you.

I140 at TSC is August 26th. Several others and I have their July apps pending. Gosh, this concurrent crap without current PD is playing havoc in several of our lives..

The fact that India and china priority dates are same for EB-2 suggests some spill over has already occured from ROW. We just do not know how much more spill over is possible.

Yes, there are laws that protect you regardless of your immigration status but how many H1 workers (who btw are non-immigrants, not immigrants) can we find here who have actually gone to the courts? Protection is really limited for an h1 worker. Your status in the country depends on your employer what are the chances you will sue the employer?

Even if you are an immigrant but as long as you are subject to the law of UnitedStates you have every right to fight discrimination and other actions that you percieve are illegal. Even Illegal immigrants can do that. It is there in one of the ammendments.

Even if you are an immigrant but as long as you are subject to the law of UnitedStates you have every right to fight discrimination and other actions that you percieve are illegal. Even Illegal immigrants can do that. It is there in one of the ammendments.

I recently got an RFE to prove that my Master's degree is a three year course (and not a two year program) because the degree and the combined three year transcript don�t specifically state that it was a three year program.
I have three year of Bachelor�s (BSc) and three year of Master�s (MCA) education, which was used to qualify for EB-2. I also have more than 10 years of experience in a related field.
Unfortunately, I only have a combined three year transcript with a list of all the courses completed as part of program (Year 01, 02 and 03) and not three separate transcripts for each year of the program.
I also have an education evaluation to prove that it is equivalent to MS in USA, which was submitted with the original application.
I recently obtained a letter from the University stating that it was three year degree program with year of joining and completing the exam but my attorney strongly recommends on getting transcripts for all the years individually, which may not be feasible to obtain in a timely manner. She is not willing to do a fresh education evaluation and to respond the RFE without transcripts of each session/year.
I know lot of my friends have successfully got their I-140 approved with a combined three year transcript from same University.
What are my options? I need a second opinion and a possible representation, if required.
