Nola,
Thanks for clarifying. IV appreciates support from LGBT community. You have done amazing amount of work for IV in the recent past. Some of the Bay area folks still remember your leadership at 5K run at San Francisco Golden Gate. You created a decent amount of buzz by bringing along your friends all the way to California.
IV members: Having said that, I would just like to remind some IV members to be mindful of the fact that we enjoy support from diverse groups of people and it makes sense to extend reciprocal courtesy when responding to some of the posts here e.g. the UAFA bill etc.
Cheers!
g
Weldonsprings, you might be mistaken about the UAFA bill which is up for a vote on June 3, 2009. The intent of the UAFA is to allow US Citizens and permanent residents to sponsor their foreign-born partners for permanent residency by means of demonstrating a "permanent partnership". Let me re-emphasize, this bill is geared primarily for the LGBT Community of which I am a proud member, so if you are supporting this bill, my thanks to you.
[QUOTE=WeldonSprings;343823]That is correct! The bills in the house and senate coming up for discussion does not mention visa re-capture. However, Please look at the titles-don't they sound the same. The contents are different. The content of S.424 is to give permanent residents the same STATUS as US citizens so that they can sponsor their wives, parents, brothers, sisters and doggies...So an amendment is necessary. That's why I have written in the original post-

Because of my one of the diseases I am always worried about DISABILITY insurance.
I always try to get Short term and Long Term disability insurances through employer.
But the problem is they always start with long preexisting exlusions and when you change jobs they dont continue so have to start new one which also has other new preexisting exlusions to start.
You can convert your longterm disability to the personal policy if you have that for long time. but they are not valid if you get new job.
Is there any private/personal (not employer sponsored) Short and long term DISABILITY Insurance policies that we can purchase out side of the job.? How are the premiums? Are they reliable?
also do any of you know case where LIFE INSURANCE was actually paid and how easy/hard the process was for family?
Also similar experiences if some one know if any one used DISABILITY INSURANCE and how hard it was?

In its Response to the Ombudsman’s 2006 Annual Report recommendation (AR 2006 – 01), USCIS agreed in principle to provide a breakdown of all incomplete cases by the number of months pending and application type.
Given the constraints of existing legacy case management systems, USCIS would today need to perform a cumbersome, labor intensive, recurring manual audit of all pending files in order to compile the suggested data. Such audits would be cost prohibitive.
USCIS has opted not to use its limited financial resources to extract data from current systems and prefers to spend it on prospective systems that are years in the planning. For example, USCIS has not made corrections to the CLAIMS 3 system to capture data on applicants’ priority date information, country of nationality, and the preference category under which the application is filed that USCIS must review before the application is accepted for green card processing.
Failing to correct the system annually results in hundreds, if not thousands, of wasted hours by all levels of USCIS leadership in trying to account for an often asked question by Congress, the Ombudsman, stakeholders, and others: “Exactly how many employment-based green card applications does the agency have pending?” USCIS still cannot answer that question today with certainty.

Looking at the trackkit data there are 2 from Nov 2003 and 1 from Dec 2003, who got green this month. Is it that USCIS doesn't have enough cases from before Oct 1 2003, to approve that are approvable.

Here is a post from Ron Gotcher's website which might be of interest to some of us trapped in EB3 I retrogression .
http://www.immigration-information.com/forums/showthread.php?t=7065
He expects visa bulletin cut off for EB3 I to jump to 2004 in coming months. No reasoning behing this though..
That looks very positive. Hope all EB3-I from 2001 to 2003 (even 2004) get their approvals this year. My best wishes are with them.
There is a limit to everyone's suffering.

Hi,
I've been reading about iv.org on Rajeev Khanna's immigrationportal.com since last few days. I just enrolled and contributed a little something thru Paypal. I am however curious about Rajeev Khanna and his office's role in this new org. Leaving aside costmetic details - the forum is more than similar to the forum on immigrationportal. Please excuse my ignorance here - both websites could be using something readily available, but I would like to know if both sites have common administrators.
Thanks

Any Ball park amount I should expect as attorney fee for the MTR ? I know some one mentioned about a CA attorney who does it for $500 but since I don't have H1 as backup , incase if I need switch back to the 2nd employer it is better to keep the current attorney ( 2nd employer ) . looks like he may not come cheap . they asked whether I want to file for Adv parol and it will cost attorney fee $800 . ( I don't have a clue why asked when my I485 is in denial stage) .
I looked at the I290B form and looks not so complicated.
But in this situation I do not want to take the risk of filing myself .
Thanks

There has been time check used to be payable to:
U.S. Department of Homeland Security - USCIS
Now at some places it is shortened to:
U.S. Department of Homeland Security
And at other places it is shortened to:
USCIS
I think, they are interchangeable.
On USCIS site: Fees should be made payable to Department of Homeland Security or U.S. Citizenship and Immigration Services. refer to first dotted instruction of http://www.uscis.gov/portal/site/uscis/menuitem.eb1d4c2a3e5b9ac89243c6a7543f6d1a/?vgnextoid=db029c7755cb9010VgnVCM10000045f3d6a1RCR D&vgnextchannel=db029c7755cb9010VgnVCM10000045f3d6a1 RCRD
It does not talk about putting US in front of Department of Homeland Security. Going exactly by USCIS instructions, lawyer did mistake - but it is OK.
Look at the PDF file for I-765 and I-131 Instructions from USCIS website (Checkout page 8)
http://www.uscis.gov/files/form/I-765instr.pdf
http://www.uscis.gov/files/form/I-131instr.pdf
Here is the relevant info from the USCIS instructions:
Use the following guidelines when you prepare your check or
money order for the Form I-765 fee:
1. The check or money order must be drawn on a bank or
other financial institution located in the United States
and must be payable in U.S. currency; and
2. Make the check or money order payable to U.S.
Department of Homeland Security, unless:
A. If you live in Guam and are filing your petition
there, make it payable to Treasurer, Guam.
B. If you live in the U.S. Virgin Islands and are filing
your petition there, make it payable to
Commissioner of Finance of the Virgin Islands.

My lawyer advised against filing AC21 proactively. His opinion is that it may trigger a big RFE requiring financial details of the new employer. How true is this? I have a feeling my previous employer might withdraw my approved I-140 on the advice of their corporate lawyers (Fragomen, who I believe recommend I-140 withdrawal as past of their standard procedure when an employee leaves). I would like to preempt that and file AC21 documentation.
Yes, most Attorneys advise against proactive filing primarily because AC21 has no formal process associated like form, fee, reciepting or standard. It is based on guidance, most times the AC21 docs may or may not reach your file.
Some Attorneys advise the HR to proactively file for AC21. There is one company (huge) where when you are being offered a job on EAD after AC21 - the HR dept makes a big fuss - asks for all documents like copy if Labor, 140, 485 reciept any any other documents and then makes you sign G 28 and then file for a G28 change in Attorney and associate AC21 docs with those. I guess, the Attorneys charge money so it is a business. If RFE or denial - then more money.
My recomendation is to hire a ethical and realistic lawyer and not a greedy one

1. If you are in IT field, you don't even have a grasp of software development lifecycle and the part QA plays in it. A good QA cycle is essential for a good quality product. It is your ignorance about software development cycle that makes you say good QA guys are not an asset for a good product and they are not smart as developers.
Well I am not a software engineer but I do understand the role it plays so I do know im not dumb. Thank you for your words of wisdom.but I wouldnt agree with the fact that people have to be flown in from other parts of the world for this, yes there are corner cases in every product validation cycle which needs really talented people the vast majority do not do that
A tenth grader with enough common sense can do good software development. India produces lot of people with good common sense and analytical thinking. That is one of the reasons for India's software boom.
IMO if you don't have a patent in your name, you are not high skilled enough.
2. How many consulting companies do you know do charge their candidates for filing H1 ? I haven't come accross any. It is illegal to do that. If someone is doing that, ICE is after them.
Do come out of your own imaginary world, I can forward you a dozen emails my wife gets from these so called messiahs of the IT industry. 3.
All I can say is you are as ignorant as some of the anti-immigrants in this country. You haven't seen the real world.Come out of your little world and look around to see the real world.
I am not anti-immigrant at all. There are good and hopeless people in every aspect of life , I see the H1-B visa or any employment based visa scheme as a prized posession and only the best should be allowed to lay claim on these ones which unfortunately isnt happening.
4. Yes, you are for whatever suits you. What about getting yourself a preferential treatment for H1B visa and GC ? Sounds good ?
No matter what I explain to you, you'd always be giving me a raw deal, I am not even going to explain myself.
BTW I am curious why you are referring to "consulting companies" as consultants. "consultant" and "consulting companies" mean different things.
OK thats a biggie I should have known better I'd be clear the next time around. Due apologies.

Hi,
I filed my I485 in Texas service center because at the time of filing it I was living in a state which was in TSC's jurisdiction. The application is still pending in TSC.
I have not filed any AP so far. I am filing it first time now.
Now I have moved to a state which is in Nebraska Service Center's jurisdiction. So should I file my AP in NSC or in TSC?
