AT JFK.
Submitted two copies of AP and passport. I had three copies from USCIS.
Went through US citizen/resident queue and the CBP officer took me to another verification counter.
There were only one other person (Russian). No questions asked. NONE. Verified address and very very informative and friendly CBP officer. Handed both AP with one of them stamped. I have all three copies of AP with me with one stamped.
He advised that every time I travel make sure there is no NOID on my case and my AP is current.

Interesting experiment, and I can see that is how human beings respond sometimes.
However we are guaranteed something in return when we TRY to do what we believe in, regardless of the odds as we see them: the satisfaction of DOING something about it, and a real shot at getting what we want.
Easy to try it. Pick anything, literally anything about your life you want to change (from changing your job to losing weight to calling up your parents more frequently).
Then WITHOUT THE FEAR OF FAILURE, do something about it. It will either work out, which will be terrific. Or it won't... maybe you don't success at that job interview after all, or you still put on weight. Even then, the satisfaction that comes from having TRIED is yours to keep! (Personally, I have found this to be more motivating for trying those things again, as opposed to the hopelessness that results from not trying and then seeing things not improve.) And of course, since failure is only one of two possibilities that there can be, you do succeed 50% of the times that you try honestly!
In case of IV's efforts including the upcoming Advocacy Day, that is exactly how I feel.

The guys from Freakonomics did an experiment in a Chicago school. They said they will give $50 to all students who will get a B or higher in all their subjects. After some time they have found out that students who were getting a grade in the vicinity of B earlier have improved their grades to B level. But the students who were already well below B, actually went down in the grading; from D to E for example. You can google for the details.
In the GC saga, what we need is a B grade or above.
EB3 Mexico already has a C grade, hence he tries hard to improve himself to a B grade.
EB3I is in D grade. We more or less feel that trying hard is a waste of our time. If we try hard, we might get a C grade (means EB2I folks will get GCs :( :( ). The end result is that we go from D to E. That is what you are really seeing.
PS: despite the above generalization, I am planning to participate in the advocacy days in DC and I have already contributed to the efforts. Because human beings defy logic and what is natural to other life forms on earth.

Theoratically what you say is correct. Once the revised bulletin came out people are not supposed to file / send out mails in this matter. However, what the AILF is going to fight is the "revised bulletin". They are going to fight that uscis cannot publish a revised bulletin at such a short notice and if they (AILF) wins, this revised bulletin is nullified and July will become open to every one with LC, right??

It is nice to see that the senior leadership is taking notice of the 'pain' some of us are going through right now.
Disclosure : I have already received 2 year EAD (thanks to IV). I have taken initiative to bootstrap the effort to help others who haven't been so fortunate. Since we are all in the same boat let us watch each others back for a change, instead of trying to backstab each other at every available opportunity.
This is NOT a yet another case tracker /EAD tracker thread. I don't believe that just tracking stuff will change anything. Be it EAD issue or any other, real world action is needed to solve it.
I have started this thread to guage the impact this issue has had on our community , how many members are affected, what actions have been taken by them, so that next steps can be taken. If a large number of members are impacted IV may decide to take up the issue.
Here are the options available to applicants
1) Call National Customer Service Center and create a Service Request (SR) to expedite the case
2) Fax and mail a letter to Service Center requesting to expedite the case due to possibility of job loss. Since the burden of proof is on the applicant - a letter from the company that EAD is necessary for continuation of job may help.
3) If steps 1 and 2 don't produce the results and CRs refuse to open SRs citing silly reasons, USCIS Ombudsman may be approached.

4) Approach your US Congressmen/women Representative/Senators. Every office has a different form for requesting Immigration help. They can open an inquiry with USCIS on your behalf.

We shouldn't feel embarassed at the question "Did you follow up with all these avenues available to you?". Our answer should be - "Yes. We did all that and it didn't help". If you have done all the four or after you have exhausted all avenues, AND are willing to take it further - speak to the media, participate in possible IV campaign etc., post your details. We need members ready to go public with the issue if we want to succeed.
Right now, I have started this as an individual initiative. But I am sure that IV will get involved once it's proven that a large number are impacted and there are enough members to turn it into a campaign.

We could not even pool $10K for FOIA. For lobbying, one needs lots and lots of money in the range of 100K -200K. What can IV do? Can you explain what you mean by "something'? if all of us EB3's can pool 100K, then we can request IV to do "SOMETHING". Hope every one understands this.

Just because somebody quoted 5K fee for such an information (which may be their standard response to such custom information extraction requests), it does not mean it can be readily found. If it were that easy, USCIS/DOS would be using it. The fact remains that PD related information does not exist other than in physical paper applications/files related with LC, I-140 and I-485. There is nothing on the system based on PD's. Don't we see it in guesswork used for advancing and retrogressing PD's. Note that for most immigration applcations PD's do not play any role. Only when at adjudication time, birth country is noted to be India/China, the officer has to check PD with respect to current cutoff dates. Systems are not designed for handling any processings based on PD's, so quick access to such information is not available - with a fee or without a fee

I hope it does some good to you and makes your PD current/closer so that you dont eat/sleep/drink VB. C mon man... There are other things you can do. Dont get offended by what I am saying. If your PD is closer, I can understand your excitement. But a lot of people are just killing time in forums by working their ass off on predictions and call it comic relief. I hope IV core members stop encouraging this kind of behavior.

I thought of leaving this company several times, but I am working in this company for 6 years and the only company I worked after coming to USA. I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. There were so many times I thought if I get my Green Card I am going to leave this moment. Years passing by and with this retrogression thing, there is very little hope of getting it soon...
The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.
I would only say "Hang On", or move on if you can. A lot of people in same situations, never want to discuss issues openly.
Patience does help, and maybe all the good is stored for future.
Most important is how you deal with stress associated with racial slurs, difference in treatment, and all the above issues. This has direct impact on health and many people in these conditions are victims of stress.

The reason companies support their American workers who involve in racial slurs is to avoid issues. It is easy to kick you out and blame you rather than catering to ur problem.

Do you know how much more the premium would be for this product compared to regular term? I am guessing a lot more. In that case whole life is better where the cash value generated would pay much more after 30 years based on a low 5.5 - 6% estimated annual return. But of course it is for folks who will stay in US at least 15 years+ because after 15 yeras the Cash Value could itself pay for the permium and you do not have to pay any more premuims unless you wish to boost the Cash Value further.
Its not a lot more.. about $200 more per year.. ... but atleast you get back all your money..

H1b and Green cards are allowed to have out of country stays. so if you are out of country for less than six months, it may still be considered as continuous stay. the intent of writing the word "continuous" is to declare that at any point, the immigrant had no intentions to leave the country and relinquish his immigrant status. for the legal immigrant, that should be acceptable.
Looks like it is for illegal immigrants as it asks for continous stay. Most legals would not have stayed continously as they might went out of country for vacation

Since most of the west coast people who found it diffcult to attend the DC rally, was because of the cost/total flight time etc, for future may be it might be a better idea to conduct coordinated east coast (DC or new jersey or where ever there are huge legal immigrant aspirants) and west coast (silicon valley/bay area) rallies simultaneously. Probably even one somewhere in middle of USA (Texas ?)..
That way, not only does it give an impression that its a wide spread effort and get better noticed, but also make it more convenient for people to attend. And also may instill some sense of friendly competition between local IV chapters to 'beat the numbers' and may encourage people to attend the local rallies in huge numbers. And also it will even out the effect of some local region having poor attendance.
Also the burden on the 'core team' will also be spread out evenly, so we can conduct more such rallies in future at a shorter notice and with lesser effort. Key to this is developing the local chapters more, making them more autonomous and regulated.
It also has been mentioned in various posts that the hierarchical structure of the organization is not very transparent and many people seem to be still confused between 'core members'/admins versus 'senior members' and volunteers. I agree IV is by us and for all of us. But it doesn't hurt to have a streamlined organizational structure...(may be such a structure is already in place...if so then it needs to be more transparent ) That will make IV look more professional also.
Coming to ideas like sending more flowers ...or stoppers etc....

Infopass and Expedite on ph did not work. My congressman office helped me to expedite AP . Mine and my wife's AP got approved even though we requested expeidited only for my wife's AP.

I have been thinking for a long time to own a gun but due to my H-1B status could'nt own one. My I-140 was approved last year and now I am working on EAD.
I am wondering if anybody else in a similar situation purchased a gun; I mean after he/she started working using EAD. I tried to research the issue but the law is not clear on the subject.
I think this is a wrong forum . you might want to get in touch with NRA (most of the members of NRA are very conservative ) .... They might help you or make you a plaintiff in a lawsuit.. Supreme court may very well favor you given their recent second amendment rulings :)

No, we are not going to abuse this and we won't be sending stuff over and over. But stoppers have a very Specific significance: to educate and differentiate between legal and illegal. A stopper says "Stop the reverse brain drain"...A stopper would pique people's interest becase we are typically lumped in with illegals, and a stopper does not exemplify what illegals are. Actually, many Indians with US Citizenship are leaving too. What I have seen with my friends and coworkers is that, the moment they receive the US passport they book a flight to India and come back when ever they please. If media picks up that fact, then what is our strategy?

I don't remember many a choice at the stage of I140. I guess the lawyer made it for me. I did not bother to even find out more details, given the hopeless situation so far for EB3, India.
My I140 says " The above petition has been approved. We have sent it to the Department of State National Visa Center(NVC). The NVC processes all immigrant visa petitions that need consular processing. It also determines which consular post is the appropriate consulate to complete visa processing. The NVC will then forward the approved petition to the consulate"
From the above statement, it appears that this is Consular processing. Could someone confirm if this is indeed CP.
Any idea , what needs to be done to change it to AOS. Is this a good idea?

After apology/providing GC, they are going to provide settlement assistance as a welcome gift....
Right!!! and in the future bulletins, the dates will continue to move to the future and all the FOBs will be forced to take the GC at the POEs else they will be denied entry into the US of A.
